National student loan debt now totals more than $1.5 trillion, and many borrowers are finding it increasingly difficult to keep current. Student loan debt has historically been very difficult to discharge in bankruptcy.  However, there is a new push by courts, commentators and attorneys to revisit the rigid test of undue hardship set forth in In re Brunner. Our panel will discuss the Brunner test, how it is being applied by the courts, and what changes might be necessary to ensure that student loan debt does not become a permanent drag on the economy and the lives of student loan borrowers.
